GSTT ancaman atau keperluan?

Posted: 27 Jul 2011 12:23 AM PDT

Dr M deserves prize for bringing accord with MCP

Posted: 27 Jul 2011 01:54 AM PDT

It is a welcome historic announcement that the celebration for the anniversary of Merdeka/Malaysia will be held on the same date as that of the formation of Malaysia.

I believe it to be in the national interest that a "token" award of a peace prize, should be awarded to Tun Dr Mahathir as well as the author of the book; 'The Finest Hour: Malaysian Government -MCP Peace Accord in Perspective', to commemorate the peace accord between the Malaysian Government and the Malayan Communist Party.

Indeed, it is most surprising that an award was not given when the agreement itself was signed.

As a result, Malaysia stands among one of very few countries in the world where political independence was declared without peace in the country.

The accord itself has spectacular significance, coming as it did thirty-two years after political independence, and after Malaysia entered the book of records as one of the very few countries in the world where peace became a reality only much later after political independence from the British.

This was the splendid achievement of Dr Mahathir, the then prime minister, in attaining peace so that the Malaysian people, particularly through the politically neutral business and corporate sectors, could embark on the development of a nation-wide
nation-building political economy.

The book is being translated to Chinese and Malaysians should now recognise this milestone by offering the Peace Prize to Tun Dr Mahathir for single-handedly orchestrating the entire peace process, as well as to the author for the publication of the book.

The tremendous and continuing post-Emergency contribution of the corporate sector towards nation-building would not have been possible without the declaration of peace whereby vital financial resources of government were re- channeled for the development of the political economy.

There is no question therefore that the book provides focused coverage of 'the Finest Hour' as that which overcame the need for mere technical explanations, in demolishing the notion of local 'Cina Komunis' attempts, to overthrow the government by revolution.

Indeed the book which in his foreword Dr Mahathir called "bold and extraordinary" with 'stunning observations', brings into sharper focus the much neglected nationalist contribution of the local Chinese community in the struggle for political independence and for peace.

For the first time ever the work, as identified by Blackwell's Encyclopedia of the Social Sciences, acknowledges that the Chinese community, labeled as Communists by the colonial power, did in fact take the lead in organising and orchestrating popular resistance among all other local groups against British rule that ultimately led to political independence and peace.

Therefore it is now opportune that the corporate sector should sponsor the lead, especially on behalf of the Chinese business community comprising grassroots manufacturing enterprises and industries, and the larger enterprises in the corporate sector, in offering this token award.

Indeed, such recognition was also called for by other groups notably by trade's union organisations one of which went so far as to suggest that a suitable "monument" be built to entrench Dr Marathir's unprecedented achievement in bringing peace to Malaysia.

The Ministries for Heritage and communication should co-ordinate these efforts as a matter of urgency.

Makna dan tanda 9 Julai

Posted: 27 Jul 2011 12:54 AM PDT

Apabila Perang Dunia Kedua pecah, Hitler mula menyerang Perancis.

Sekarang mari kita sama-sama melihat kembali pensejarahan 9 Julai.

Rentasi Garis Maginot, bakar kapal perpaduan

Polis belum putuskan permit perhimpunan anti-Taib

Posted: 26 Jul 2011 10:03 PM PDT

RCI findings raises more questions than answers

Posted: 26 Jul 2011 04:24 AM PDT

It appears the royal commission into Teoh Beng Hock's death has fallen short of its purpose of uncovering the true cause of his demise and allaying public concern over culpable conduct by the MACC.

Instead its 'suicide' finding raises more questions than answers and more importantly, failed to give comfort to Teoh's family and friends who believe that he was killed and did not commit suicide, a view shared by many Malaysians.

They raise the question of the usefulness of a costly exercise that failed to include the possibility of political interference that may have contributed to Teoh's tragic death.

If there was no political influence why did the MACC investigate a trivial case when relatively larger cases involving huge amounts of money reported to or known by the MACC, have not been touched?

Despite the RCI the public will not know how Teoh died and they won't know the reason why.

Political interference was not included in the RCI's terms of reference but could have thrown light on why there appeared a motive for early results when one thinks of a normal investigation as achieving that aim in due course, only after all the evidence has been examined and not exigently, and unreasonably within a matter of hours, as in Teoh's case.

In paragraph 339, the RCI report noted that 'HH' the officer in charge, who absolved himself of direct participation in the interrogations, "not only was involved but he also unleashed his officers to do his bidding in order to get results within that night or morning come hell or high-water."

The commissioners' poignant comments imply HH had to get the 'results' with a high degree of urgency.

But why? Would Teoh still be alive today if matters were allowed to take its normal course?

Instead we have criticisms that Teoh's death has been politicised. This is baffling because Teoh was the staff of a politician and has been the 'collateral damage' of a perceived political witch-hunt.

Anything related to his case has to attract a high degree of political involvement and that incidentally is not unusual in a country where the public institutions don't always act independently but 'take orders' from the politicians.

Politicians are often the only ones left to offer help to aggrieved citizens when they are led into a bureaucratic cul-de-sac. It is the inordinate politicisation of the public institutions by the government that the public may be more concerned about.

It is not unknown that law-enforcement agencies face undue political interference as demonstrated by the previous complaints of the country's top cop after his retirement.

Kim Quek also highlighted the commission's shortcomings in his article 'Teoh's suicide - fact or fantasy?' with cogent comments that the reasonable person would find difficult to refute.

In reading the RCI report and considering the controversial evidence on which the decision of 'suicide' was made, the finding does not do justice to the elusive truth, and the truth is unlikely to surface when the commission complained of facing a 'blue wall of silence' and flagrant lies from MACC officers, besides other serious flaws.

Thus fact or fiction? is a reasonable poser. It would be difficult for anyone to ask others not to speculate when in the end, the commission's finding on Teoh's death is unfortunately speculative itself (quite different from the conclusion of an open verdict in the previous coronial inquest that said it was not suicide or homicide) and one that only considered certain scenarios but not all scenarios.

Is it not conceivable that he could have been carried and thrown out of the window without a struggle while still asleep or drowsy or drugged and awoke as he fell, thus not leaving signs of a struggle as evidence on his killers' clothing?

That would be pure conjecture on my part but it begs the question: how is that different from the commission's 'explanation' of Teoh's death?

Is it not conjectured that Teoh killed himself?

Truth and justice are at risk if conjecture, instead of reliable evidence, forms the basis of any judicial decision. And it is a world of difference between someone murdered and someone taking his own life, even if blood is on the hands of the same perpetrators.

Ironically the commission had dismissed pathologist Dr Porntip's evidence of strangulation (but did not consider partial strangulation) to explain a mark on Teoh's neck as 'speculation', while relying on its own speculation. So much for consistency.

The commission, however, did point the big finger at the MACC officers for driving Teoh Beng Hock to his death. They found no 'smoking gun' but established that Teoh was inhumanely treated before his untimely death.

What is not doubtful also is that the report highlighted the appalling modus operandi of the MACC officers.

Revelations of lying and deceitful conduct by MACC officers resulted in scathing criticisms by the commission but they fell short of recommending those culpable be prosecuted.

Any suggestion the MACC needs a drastic overhaul is beyond doubt. From the minutest detail of smoking in a no-smoking government department to respecting the human rights of those interviewed and even the welfare of MACC staff (the two who dobbed in their superiors should be promoted) the MACC needs critical major surgery not another facelift and name change.

Law enforcement officers who do not respect the rule book and who take the law into their own hands are a menace to society. The expose by the RCI of the MACC's flaws may partially explain why corruption remains the country's most serious problem.

Is the MACC a viable institution up to the task of tackling the country's most serious social disease?

If there is a silver lining it is the commission's recommendations that the 'PEACE' model be used. This non-coercive approach used by law enforcement agencies elsewhere should be adopted for all law enforcement agencies in the country, not just the MACC.

The MACC needs to adopt a 'hound-dog' approach that relies on the examination of documents, the audit trail of transactions, the corroboration of information and much public cooperation. The RCI did recommend the use of 'forensic accountants' a step in the right direction.

Corruption after all is a 'white-collar crime' and the approach should be devoid of strong-arm measures.
It should not function like a coercive secret police unit.

After all I doubt the income tax inspectors detain their witnesses and even suspected tax evaders overnight and subject them to such inhumane treatment as meted out to Teoh.

Ultimately the real problem of the propriety and efficiency of law-enforcement is not one of strategy or know-how but political will.

Until there is a genuine determination by the government to root out corruption, obtain help from every quarter and restore the independence of the country's public institutions, every law-enforcement agency and the politicians themselves will continue to be tainted with scandals.

The MACC has another death on its hands to explain following so soon after Teoh's. It is a further symptom of the same disease. The call for urgent redress is critical.

The MACC is an institution in distress.

How many more Malaysians will die unjustly and unnecessarily is the question only those in power can answer? If it is up to me the answer is 'zilch.'

One death in custody is one death too many. The buck has to stop with those who allow the innocent like Teoh to die.

With the RCI's findings of malpractice within the MACC that resulted in Teoh's death, the need for further probes into the other deaths in custody in and outside of the MACC and the installing of preventive and remedial measures in those public institutions has become more urgent.

Teoh Beng Hock has not been vindicated by the RCI's finding, perhaps only further hurt by the finding of 'suicide.'

But he is a martyr, a victim of a perverted bureaucracy that betrayed him when he willingly placed his life into the hands of the MACC.
He made a fatal mistake of trusting the authorities.

Until the government can safeguard those that for one reason or another is in the custody of its authorities, blood will be on its hands, when an innocent life is lost.

Teoh's death is not in vain.

His sacrifice will yet save many lives and sound a warning to the authorities that they will be held accountable for their reprehensible conduct.

It may be small comfort to Teoh's family and friends for I am sure it is not vengeance they seek but justice.

Justice comes from a public that believes in the truth that will some day surface when those in power will set it free. Meanwhile they lament the death of a law-abiding citizen who obeyed his government and lived by its rules and paid with his life.

Teoh Beng Hock is the victim of a government who failed him.

Whether the MACC officers will be the fall guys who will pay for their aberrant conduct is another drama still to be played out.

This latest RCI has exposed serious shortcomings in the MACC as another one did a few years ago of the Malaysian police force in its inquiry.

The question uppermost in our minds is what does a RCI in Malaysia really achieve?

And when will the government stop the alarm in the community of seeing so many innocent Malaysians die in the custody of the authorities or imprisoned like the PSM6 and go through the gauntlet of risks they may not come out alive?

Let's do it like the Brits

Posted: 26 Jul 2011 03:45 AM PDT

I was watching the live telecast of the emergency session of the British parliament in relation to the phone hacking scandal in the BBC and I must say that in that two hours of relentless questioning of the British prime minister by the members of Parliament, I have actually seen more of the proceedings in the British Parliament rather the Malaysian Parliament although I am a Malaysian who has voted in three general elections.

Despite having voted in three general elections, I have yet to see any session of our Parliament being telecasted live on TV. If the British can do it why can't we!

After all we are a parliamentary democracy with a Westminster style legislature. I think it's the people's right to see how our elected representatives are performing in Parliament.

The conduct of the British MP's from both sides of the divide was most exemplary.

They were not rude to each other perhaps a bit of sarcasm but that is forgivable, no statements with racial undertones were made although there were non-white MPs who questioned the PM, the male MP's were full of respect for the female MP's (they were not patronized in any way by the male MPs), they never interrupted each other and more importantly, the speaker's role was respected i.e. his instructions were fully abided by the MP's. This is what a first world Parliament is all about.

All this was in stark contrast with our Members of Parliament, where we have heard and read about how our male MPs make patronising statements about female MP's and women in general (remember the 'bocor' statement and controversial statements about female drivers etc), name calling (monyet and katak), use of racially offensive words (keling and pendatang for e.g.), shouting in Parliament, undermining the speakers position by refusing to follow instructions and the list goes on.

In short, some have said we a notorious Parliament with some notorious MP's.

I think its time for our MP's to learn a thing or two from their British counterparts.

For a start at least please telecast each parliamentary sessions live on TV so that at least we get to see and hear the proceedings in Parliament and the depth of the issues and arguments raised.

This is the first major step in realizing a first world Parliament.

Suaram: Budaya 'terlepas hukuman' makin buruk

Posted: 25 Jul 2011 11:19 PM PDT

SPRM pamerkan bilik soal-siasat baru

Posted: 25 Jul 2011 10:57 PM PDT

Zunar ban more dangerous to M'sia than cartoons

Posted: 25 Jul 2011 04:23 AM PDT

Cartoonists Rights Network International (CRNI) is a free speech and human rights NGO protecting and monitoring editorial cartoonists around the world who find themselves in trouble because of their influential cartoons.

For the last 10 years the government of Malaysia has been seeking to silence one of the more popular political cartoonists in Kuala Lumpur, Zulkiflee Anwar Ulhaque, better known as 'Zunar'.

In the past two years he has been arrested and detained, his office has been raided, his cartoons books have been seized, and his publishers and editors have been prevented from publishing his cartoons. Zunar recently took the government to court appealing last year's decision to ban his books

On July 14, the High Court in Kuala Lumpur decided to uphold last year's banning of his political cartoon books and dismissed his appeal.

'Perak Darul Kartun' and '1 Funny Malaysia', which featured more than 150 individual cartoons, were initially banned by the Malaysian government in June 2010 under Section 7 of the Printing Presses and Publications Act of 1984.

Without elaborating, the judge held, "their contents are not suitable and are detrimental to public order". Nothing could be further from the truth. These two books focus the public's attention on important political and social issues such as conspiracies against the former Deputy Prime Minister Anwar Ibrahim and the murder of Mongolian model Altantuya Shaariibuu and the Scorpene submarine scandal.

CRNI deplores the decision of High Court Judge Rohana Yusof who agreed with the government's argument that the cartoons would lead to public disorder.

As influential as Zunar's work is in shaping Malaysian pubic opinion, there is no evidence that the cartoons would lead to public disorder. In so ruling, the court has furthermore ignored freedom of expression rights as provided by the Malaysian federal constitution.

CRNI has reviewed the banned cartoon books 'Perak Darul Kartun' and '1 Funny Malaysia' and found that all the cartoons in these books are in keeping with excepted international standards of political cartooning.

CRNI is deeply concerned that by this decision the court gives a license to government to act more harshly in suppressing both political cartoonists and investigative journalists. In the long run suppression of speech is a much graver threat to public order than one cartoonist's well-informed opinions.

CRNI urges the Malaysian government and the Malaysian Court to respect the rights of free speech for all Malaysian citizens and reverse its July 14 decision.

Robert Russell is director of CRNI.

Bersih 2.0 a true display of Malaysians' strengths

Posted: 25 Jul 2011 03:36 AM PDT

I came to Malaysia on June 14 with the intention of conducting research on race and government policy in Malaysian secondary schools and universities. The topic seemed to be the most rich and interesting at the time.

However, my real interests lie in political agency and human geography. So it should come at no surprise that I instead dove into the political scene. I met some really great people and got involved with the group from 50B. And you better believe that I was at the rally this past July 9.

I have written already about my personal experience at the rally, which was, by the way, fantastic. From reading various post-rally articles and Twitter updates, I think that people have already talked a lot about camaraderie. So I'm going to talk here about diversity.

From what I have observed in this country, diversity can be turned into real power if used well. At the rally, there were people of all races, age groups, and socioeconomic backgrounds. In addition, the crowd was coloured with people of different political views.

The rally-goers were not a homogeneous group by any stretch of the imagination. Differences and disagreements did not keep people from coming together at this rally. And this is what made it seem more powerful for me.

The fact that so many different people came together to stand for whatever cause (for Bersih, for general discontent with the government, etc.) disproves the idea that the Malaysian population is plagued by inherent racism.

The numbers also disprove the idea that the Malaysian population is apathetic and easily deceived. People are really coming to desire change. And its infectious. In addition, not only are people desiring such change, but they are willing to take action to ensure that it happens.

I want to thank everyone who made this experience so exhilarating and empowering for me, and I hope to rejoin the masses for the next battle, whatever and whenever it may be.
