Wahabi: Perkara usul atau furu'?

Dalam masa terdekat ini ada dua kali saya terbaca dalam harian Sinar mengenai Wahabi: Satu mendesak Kerajaan Malaysia memutuskan bagaimana dengan kedudukan Wahabi; dan satu lagi mendesak agar dialog segera diadakan.

Musuh menggelar mereka Wahabi, tetapi mereka sendiri menamakan diri mereka Salafi bermazhab Hanbali pengikut Ahmad ibn Hanbal. Kalau Ahmad ibn Hanbal diterima, tetapi Wahabi dipertikaikan, maka "itulah sejauh-jauh pengetahuan mereka".

Sebelum apa-apa, saya mohon tentukan lebih dahulu adakah Wahabi itu perkara usul atau furu'?

Perkara usul : umat Islam menerima atau menolaknya dengan ijmak.

Perkara furu' : umat Islam menerima atau menolaknya tidak ijmak.

Sebagaimana perkara lain dalam Islam, masalah Wahabi bukan ada sempadan geografi yang boleh ditentukan oleh Kerajaan Malaysia. Islam adalah satu dan sama dalam dua perkara, iaitu usul dan furu'. Dalam usul bersatu dan dalam furu' berbeza.

Perkara usul adalah seperti perkara-perkara yang terkandung dalam Rukun Iman dan Rukun Islam, umat Islam Ahli Sunnah tidak boleh berselisih faham. Sebab itu Agama Qadiani, Baha'i dan Isma'iliyah-Batiniyah umpamanya, semuanya terkeluar dari Islam Ahli Sunnah dengan ijmak.

Perkara furu' pula adalah seperti berkaitan dengan masalah-maslaah yang ditimbulkan dari Akidah di gelar Ilmu Kalam.

Kata Ghazali dalam kitabnya Qawa'id al-'Aqaid:

1. Ada yang mengatakan Ilmu Kalam itu bid'ah atau haram.

2. Ada yang mengatakan wajib dan fardhu.

3. Ada yang megatakan fardhu kifayah; dan

4. Ada yang mengatakan fardhu 'ain.

Di antara yang mengatakan haram itu ialah Imam Syaf'ie, Malik, Ahmad ibn Hanbal, Sufyan dan semua golongan Salaf yang terdiri daripada Ahli Hadis.

Dari empat pendirian ini, kalau tidak silap, ada golongan di Malaysia yang mengatakan Ilmu Kalam itu wajib dan fardhu 'ain. Pada masa yang sama, mereka kukuh berpegang dengan Mazhab Syaf'ie yang mengatakan Ilmu Kalam itu haram. Saya tidak pernah dengar dalam zaman ini ada di antara orang Islam yang memihak kepada salah satu daripada empat pendirian tersebut dan mengajak berdebat kalau ada orang menyalahi pendiriannya. Inilah yang saya maksudkan "perkara furu'.

Sebelum apa-apa tentukan lebih dahulu dijelaskan adakah Wahabi itu perkara usul atau furu'.

• Pihak yang bersungguh sangat perkara Wahabi, adakah Wahabi itu termasuk perkara yang menyalahi Usul Islami dengan ijmak, bahwa sesiapa yang menganutnya akan terkeluar dari Islam. Jika demikian, tidak perlu didebatkan lagi.

• Adakah di sana orang yang memandang Wahabi perkara Furu' yang khilafiyah belaka. Jika khilafiyah, maka memang ada perbezaan yang tidak dapat dielakkan.

Dalam mana-mana mazhab ada mereka yang bersikap keras, ada yang bersikap sederhana dan ada yang bersikap tak kisah.

Sikap sederhana membuahkan perpaduan dan hormat menghormati.

Sikap keras membuahkan perpecahan dan benci membenci.

Adakah sikap itu hasil kajian yang terkini lagi teliti?

Atau datang daripada apa yang diketahui selama ini?

'No, I haven't quit as MoCS leader ... not yet'

The article below was published in the New Straits Times today under the heading 'Siah quits over failure to oust Taib'.

It is fair but not altogether correct. My clarifications are in bold.

KUCHING: The Movement of Change Sarawak (MoCS) head Francis Siah has called it quits, a day after a rally he organised to drum up public support to drive Chief Minister Tan Sri Abdul Taib Mahmud out of office failed to materialise.

I did not quit that day (Aug 13). I said in our MoCS blog that 'it's time to pass the baton'. So until the MoCS committee meets at a date yet to be decided, I will carry on as the movement's leader.

The rally was called off for reasons of public safety and that I did not want to see anyone injured or arrested. Also, key MoCS leaders were served with a restraining order.

In a statement yesterday, he announced he was stepping down as head of the movement over the failure.

It was not a statement. I did not issue a statement to the NST. The story was written with quotes from my letter posted in our blog.

Yes, it is true that I've failed to oust Taib within the 12-month time frame which I set as a challenge for myself. So it is not exactly the movement's agenda which is a long-term struggle for democratic reforms and good governance.

He said when he formed the movement on Aug 13 last year, he had stated to the eight initiators of MoCS that he would take a year off from work to head it.

Siah said he had set a one-year time frame to lead the organisation, in its bid to oust Taib.

He said the deadline came up on Saturday, and he had completed his term despite the organisation's failure. "Now, it's time to pass the baton."

Siah also acknowledged that he had come under a lot of criticism from so-called supporters for calling off the rally and was hurt by the insults hurled at him.

No, the criticisms were not from MoCS supporters but more from the comments in the web portals and blogs. The majority of our supporters understood my reasons for calling off the Red Rally.

Criticisms, which were expected, could possibly be the work of cyber troopers engaged by MoCS's detractors.

"It's so easy to instigate and provoke. But where were these people when we needed them? None offered MoCS anything other than mere words.

"In their comfort zone, they have started lambasting me in Web portals and blogs. This was expected."

He also implied he was not getting any help from "friends" should anything happen to him or the organisation.

This last paragraph is incorrect. Of course, we have many friends who have assisted us in various ways over the past year.

Otherwise, how could MoCS, as an NGO and voluntary organisation, survived for one whole year?

I've contacted NST journalist Desmond Davidson in Kuching. He explained that he actually wrote a longer story but it was edited and 'butchered'.

Being a newspaper man, I understand the page constraints of a tabloid like the New Straits Times.

Somehow, it must have been over-butchered at the subs desk. That could possibly be the reason for this incorrect final paragraph.

Errant 6P 'amnesty' agencies a major scandal

To Yg Bhg Mahmood Adam, sec-gen Home Ministry

Dear Sir,

I have read and fully agreed with your article in Star Pg34 (Views) on Saturday Aug 13, where you related 'The Art of Engagement' quoting Helen Keller, "I am only one; but still I am, I cannot do everything but I still can do something, I will not refuse to the something I can do," and also the last phrase of your article, "Alone we can do so little, but together we can do so much."

But Sir, if you trust the wrong persons to do it, it will be even very damaging to your reputation and career and you may have countless of nightmares after the programme.

I do admire your commitment and courage to implement the 6P programme to register illegal immigrants, which you have described and admitted as "massive and messy" in the midst of the poor perception of the people towards the government and its performance.

With this 6P registration going to end very soon, I urge you to take serious action against these unscrupulous agents which you have trusted to do the job. You should personally, or ask your enforcement officers, preferably Chinese or Indian (as agencies may suspect Malay officers of being KDN officers), to call these agents at all their branches .

There are banners everywhere; please try calling the handphone numbers stated in the banners and if not, call their main office and branch telephone numbers at different locations. The answers you will receive from the handphone numbers and office numbers of their head office and branches are totally different.

You can also see that most contact numbers on the banners are handphone numbers, and they will just disappear with the money (RM335 to RM3,500) when the illegal workers are not approved under the pemutihah or legalisaton process. It will turn into an international mockery and laughing stock on your Ministry.

The best way for you to expose this is to deploy a team of undercover officers to visit their offices and branches in KL and other states, and pretend to be an employer, and if possible bring along a foreign worker with you.

You will then have a clearer and precise view on the ground situation. Please summon your officers to enforce the rules that you have set and arrest these culprits immediately as the registration will end on Aug 21, 2011.

It is also very encouraging to hear your boss, Hishammuddin Hussein, who has informed the public that MACC should even check his ministry's staff, Immigration and KDN officers. As we say, transparency should begin in your own house.

I salute him for his words but action always speak louder than words. The public and employers want to see action and not press statement after statements with no significant follow up when everybody knows what is going on. Even Star has reported many incidents of such cases.

Another figure to note is your relentless deputy Alwi Ibrahim, who has repeatedly warned the 336 agents appointed by your Ministry not to collect the RM300 and just collect the registration fee of RM35, not even one cent more.

However, if you care to call up these agencies and pretend to be an employer, you will understand the actual situation on the ground. As a concerned employer, my staff and I have called up and/or visited 60 listed agencies and to my astonishment, out of the 60 agencies, 51 of them told us to pay between RM335 to RM3,500 for an illegal worker registration fee.

They impatiently informed me and my staff that it is a package deal and if I refuse to pay, I should go elsewhere to register.

The following are the 51 agencies (out of the 60 listed agencies) who had overcharged employers and illegal foreign workers which my staff and I had called and/or visited during the last two weeks:

These agents are very smart and they issue two receipts, one for RM35 and the other for the remaining service charges between RM300 to RM3,500 (including levy and other fees). So when your Immigration officers plan to raid these offices and its branches, they will show you the RM35 receipts.

I believe your enforcement team should be experienced to know how to track and investigate these agencies by portraying as employers and rather than showing up in uniform.

During our calls and also visits, we have asked them the reasons for the high fees, and they gave us the followings reasons:

1. High maintenance cost (the system apparently costs them about RM8,000 per month). We are curious and hope you could explain why a computer with webcam and printer costs so much? I think you can get such set at the cost of not more than RM4,000 at any computer shop.

2. As complained by the agents, they have appointed many subagents in various locations and these agents and sub agents do not trust each other and as such, it would be safer to collect the RM300 – RM3,500 (including govt levy and other fees) first instead of waiting for the approval. Some of these agents are individual firms who don't know the rules and only do it for self interest.

3. They claimed that they have to pay some government officers (from KDN, JTK and Immigration) and politicians for approving their license. I believe when you arrest these agents they will be able to name the corrupt government officers and politicians involved.

4. Some complained to us the government policy is not clear and they do not trust the government as the policies always change.

We urge you and your team and even the MACC director of investigation Mustafar Ali to immediately investigate these companies mentioned above, and if it is true they had collected more than RM35 for registration fees, please expose these companies in the press and cancel all their licenses, including their other government licenses as they have blatantly defied Alwi Ibrahim and KDN's warnings.

Your reputation to make this 6P programme successful is vital as the whole country is looking at your performance, including your boss the minister of home affairs, the prime minister, MACC, NGOs and the rakyat.

There may not be many people who are willing to write such a letter to you, but as a responsible citizen, I was attracted by your article in the Star to volunteer and share information for a common responsibility.

Many of my peers and association members have complained to the phone number you have mentioned in the press - 03-8886 8110/8112 - but your officers don't even take down the name of companies who had raised their complaints.

Sir, I am very sorry to say that what you have preached and what you practise are totally different. We sincerely hope you will act fast to resolve this major corruption scandal.

I do not wish to disclose my company identity at this moment but I have already registered my illegal workers with the Immigration Department recently. In order to clear your good name, please act immediately and transparently as you can see this email is copies to the press, media and NGOs.

We trust your wisdom in acting fast.

Isu gereja: Islam benar guna kuasa, kata NGO

Ikatan Muslimin Malaysia (ISMA) terus membela tindakan Jabatan Agama Islam Selangor (JAIS) menggunakan kuasa yang ada padanya ketika memeriksa sebuah gereja di Petaling Jaya.

NGO Islam itu sekali gus menolak pandangan bekas mufti Perlis Prof Madya Dr Asri Zainul Abidin bahawa Islam ditegakkan dengan hujah semata-mata.

azlanIni kerana, menurut Pengerusi Biro Latihan Kepimpinan ISMA Mohd Hazizi Abdul Rahman, kenyataan itu tidak tepat dan dikhuatiri mengundang salah faham di kalangan masyarakat.

"Ini kerana Islam tertegak atas dua tonggak iaitu al-Quran dan Sultan, yakni hujah dan kekuasaan," kata Hazizi dalam kenyataannya hari ini.

Hazizi mempertahankan hujahnya dengan memetik kata-kata Saidina Uthman bin Affan yang berbunyi: "Sesungguhnya Allah melarang dengan kuasa sesuatu yang tidak terlarang dengan al-Quran".

"Sewaktu fasa Mekah, Rasulullah SAW berjihad dengan hujah dan penerangan.

"Namun semasa fasa Madinah, setelah baginda berkuasa, baginda berjihad dengan hujah dan kekuatan (undang-undang, penguatkuasaan dam peperangan) secara serentak," tambah Hazizi.

Kes putera mohon penjarakan bonda selesai

Anak saudara Sultan Selangor, Putera Azamuddin Shah Abdul Shah yang sebelum ini membuat permohonan komital terhadap bondanya sendiri, menarik balik permohonan tersebut hari ini.

Hakim Mahkamah Tinggi Amelia Tee Hong Geok Abdullah membenarkan permohonan Putera Azamuddin Shah tanpa sebarang kos dalam kamar di Kuala Lumpur dengan dihadiri peguam Datuk Rajan Navaratnam yang mewakili Putera Azamuddin Shah dan peguam Jabeer Singh, mewakili Tengku Putri Arafiah Sultan Salahuddin Abdul Aziz Shah.

Rajan memberitahu pemberita bahawa kedua-dua pihak bersetuju menyelesaikan pertikaian secara baik dan terma-terma yang dipersetujui dirahsiakan.

Pada 8 Jun lalu, Putera Azamuddin Shah memohon perintah komital untuk memenjarakan bondanya kerana gagal menandatangani dan mematuhi perjanjian jual beli saham syarikat Sunshine Fleet Sdn Bhd berjumlah RM2 juta.

Mengikut notis usul, Putera Azamuddin Shah berkata mahkamah telah membenarkan permohonannya untuk perintah pelaksanaan spesifik pada 19 April lalu, dan bondanya dikehendaki menandatangani dan mematuhi perjanjian jual beli saham itu dalam tempoh lima hari selepas itu.

Bagaimanapun, putera itu mendakwa bahawa bondanya sehingga kini dengan sengaja tidak berbuat demikian dan ini jelas mengingkari perintah mahkamah.

Afidavit sokongan Putera Azamuddin Shah menyatakan bahawa bondanya telah bersetuju untuk membeli kesemua 100,000 unit saham miliknya dalam syarikat Sunshine Fleet Sdn Bhd.

PAS Perak: court ruling exposes Felcra fraud

The lawsuit against Federal Land Consolidation and Rehabilitation Authority (Felcra) has exposed fraudulent practices in the agency, said PAS.

The trial that has just concluded in favour of the plaintiff Mohamad Ramly Sanji, a descendent of a Felcra scheme participant, has revealed that Felcra "has long cheated" the defendant's mother, said Mohd Hafez Sabri, special officer to PAS Perak commissioner.

He said the Ipoh High Court in arriving at the decision has ruled that the agreement between Felcra and Mohamad Ramly's mother was not valid.

The plaintiff, with the help of PAS initiative Badan Bertindak Peserta Felcra (Bapa), had sued Felcra for invading his two hectare property in Kacu Tapah, Perak, that he had inherited from his mother, a former Felcra participant.

Felcra had attempted to take over the land for palm oil plantation.

Hassan Abd Rahman, the Ipoh High Court judicial commissioner, issued Felcra a mandatory injunction to vacate the land in 30 days at the agency's own cost.

He also ordered Felcra to compensate the plaintiff with costs to be assessed.

The win chalks a victory for Bapa, that Mohd Hafez says is actively touring Felcra schemes nationwide to create awareness and help participants get justice against any wrongdoing by Felcra.

Ramadan a time to be considerate

I refer to the letter 'Islam not confined to personal worship' by Ms Rafidah Mokhtar. In her letter she attempts to address three issues: the opposition towards the banning of entertainment outlets during the fasting month; the Jais debacle; and eating halal.

Failure to comply to the wishes of PAS does not equate to Islamophobia and I fail to understand the author's simplistic argument linking the banning of entertainment outlets during the fasting month to resentment towards the governance of Muslims.

It is especially during the holy month of Ramadan that Muslims must be reasonable, rational and considerate to others in the practice of their faith. It is tempting to impose the same conditions for Muslims to non-Muslims in demonstration of religious zeal.

In my opinion, the proposal to ban the operation of entertainment outlets for a month was wisely withdrawn. Who will compensate the businesses for the loss of income as a result of closing for a month? It may be true that the major business owners would be able to absorb a month of no revenue but who will pay the salaries of the workers and provide for their families? It is unlikely that they will be employed for that duration.

I ask Rafidah: are the Muslim majority in Kedah the main clientele for these 300 nightspots? She certainly implies it to be so. Each individual Muslim has the responsibility to be disciplined in the practice of their faith.

Are we children that we need to get all manner of temptations out of our sight to enable us to continue fasting? Are our discipline and faith so weak? Please don't take it out on our non-Muslim brothers and sisters.

Ramadan should not be an opportunity to demonstrate your personal faith by depriving others of their livelihood. It is also not a time to impose your own values onto others, especially those not of your faith. Just because you are the majority does not mean you ignore the rights of others. Might is not right.

On the Jais incident, overzealous behaviour and the apparent lack of respect for the sanctity of non-Muslim religious places brought on the problems currently faced by the department. Jais or any religious body for that matter do not merit unthinking obedience by all and they must learn to be accountable for their actions.

To date, they have not produced the original complaint, a warrant which provided them with the authority to inspect the premises, and the evidence proving that proselytisation and the conversion of Muslims occurred at the premises.

On the other hand, if Jais' actions are valid and proven justified with the necessary evidence, then the law provides guidance as to what needs to be done.

However, if past incidences have anything to go by and the fact that this event was in fact a fundraising dinner, this raid will be another unfortunate incident where a government religious body has been duped by persons of paranoid and overzealous nature similar to what happened with the Perak mufti in 2006 (who had then claimed a church had converted over 100,000 Muslims).

Ms Rafidah also had issues with Mariam Mokhtar's article regarding 'halal'. The misrepresentation by Rafidah of the article on the issue of halal does Mariam an injustice. The concept of halal was neither the issue nor being questioned by the author. Obsession was the point of her article.

Like many Malay Muslims in Malaysia, I have been the recipient of lists of products allegedly found to be non-halal. These lists are usually generated by religious groups who give little or no explanation of the methodology used to demonstrate their claims.

Interestingly, the allegations have often one thing in common: the presence of pork products. If any of the lists are to be believed wholesale, three quarters of items contained within the typical Malaysian Muslim household would be deemed non-halal.

This would include items such as chocolate, coffee drinks, paint brushes, peanut butter, toothpaste, milk, clothing, sauces and cordial beverages. These lists can be very long and it seems that the shadow of the pig falls on everything.

I was told of a recent incident whereupon a Chinese pau seller was forced to move his stall away from a common food court area after threats of violence were made by a group of Malaysian Muslims.

The steam from the pau (none were pork based) was deemed by the latter to be non-halal. Isn't this and the lists mentioned an example of an obsession? At what point does being careful become paranoia and obsession? Rather than gaining enlightenment, certain groups of Muslims in Malaysia seem to fall deeper into a well of ignorance of their own making.

I find Ms Rafidah's assertion that Islam as practiced in Indonesia and "the culture there is not considered as the gold standard of Islamic practice" to be an embarrassing and insulting statement. This holier than thou attitude is not the mark of a good practicing Muslim.

Unfortunately, by our own actions and words, we are fully capable of painting a bleak picture of Islam to others. We often expect and demand that others understand Islam and accept us. It appears to be a struggle for us to make a sincere effort to learn the faith of others and to accept them.

Ms Rafidah rightly points out that Islam is a way of life. I suggest that we start living it the way the Prophet espoused: in peace, harmony, acceptance and celebration of diversity, and with the enlightenment of knowledge.

Jakim sedia bincang dengan JK fatwa P Pinang

Jabatan Kemajuan Islam Malaysia (Jakim) sedia berbincang dengan Majlis Fatwa Negeri Pulau Pinang berhubung fatwa yang mengarahkan pembesar suara tidak digunakan untuk memperdengarkan bacaan Al-Quran sebelum waktu Subuh di negeri itu.

Menteri di Jabatan Perdana Menteri Datuk Seri Jamil Khir Baharom berkata, pihaknya akan meminta Jakim membincangkan permasalahan itu kerana terdapat perkara yang perlu diselesaikan pada peringkat pentadbiran terlebih dahulu.

"Kita minta Jakim memanjangkan perkara ini untuk diperbincangkan bersama sebab ada perkara-perkara yang perlu kita selesaikan pada pentadbiran yang bukan memerlukan kepada muzakarah ataupun fatwa," katanya kepada pemberita di Majlis Iftar Perdana bersama Menteri di Surau Kampung Kilang Ketapan, di sini, semalam.

Beliau berkata isu azan itu juga wajar dibahaskan dalam perbincangan Muzakarah Fatwa agar dapat memberi manfaat kepada seluruh umat Islam di negara ini.

"Saya ada berbincang dengan Pengerusi Majlis Fatwa, hal-hal yang seperti ini elok juga dibahaskan supaya bukan hanya satu pandangan negeri, tetapi diangkat untuk pandangan semua pihak agar sebarang persoalan dapat kita putuskan dengan kebijaksanaan yang boleh berikan manfaat kepada semua umat Islam," katanya.

Jamil berkata masyarakat juga perlu memahami situasi yang berlaku di Pulau Pinang itu merupakan keputusan daripada Jawatankuasa Fatwa Negeri dan ia berbeza dengan peringkat pusat.

Beliau berkata pada peringkat pusat terdapat Muzakarah Fatwa dan Majlis Fatwa yang masing-masing mempunyai peranan berbeza.

"Majlis Fatwa kita hanya bersidang pada perkara yang berkaitan dengan keperluan terutamanya oleh pihak negeri, Raja-raja (yang) memohon untuk kita membuat satu pandangan dan keputusan pada suatu hukum.

"Muzakarah Fatwa pula membincangkan beberapa perkara yang menjadi persoalan ataupun mencari hal-hal yang berlaku di kalangan umat Islam yang memerlukan kepada pandangan daripada para ulama," katanya.

NGO Islam gesa akhbar jangan putarbelit isu akidah Islam

Sidang meja bulat NGO Islam yang semalam meluluskan 10 resolusi termasuk menggesa supaya isu berkaitan akidah umat Islam tidak dimanipulasikan dan diputarbelit oleh akhbar untuk memberikan kelebihan politik kepada sesuatu pihak sehingga memecahbelahkan perpaduan umat Islam.

Selain itu, mereka juga menggesa Jabatan Agama Islam Selangor (JAIS) dan pihak-pihak berwajib yang lain segera membuat tindakan dan pendakwaan jika benar terdapat usaha memurtadkan umat Islam sebagaimana tuntutan pengerusi Majlis Fatwa Kebangsaan dan bekas pengerusinya.

Mereka juga menuntut semua pihak yang pernah terlibat merobohkan institusi Islam, termasuk meruntuh institusi pendidikan Islam, masjid dan surau, memohon maaf kepada seluruh umat Islam di Malaysia kerana tindakan mereka telah mendorong agama Islam tidak dihormati.

Sidang meja bulat itu diadakan di Kompleks Perumahan Exco Kerajaan Negeri Selangor itu turut disertai Dewan Pemuda PAS Pusat.

Menurut presiden IlMUAN, Dr Fuad Salleh, resolusi lain yang diluluskan dalam sidang meja bulat tersebut ialah:

1. Bersepakat dan beriltizam untuk mempertahankan pegangan akidah umat Islam di negara ini daripada dicerobohi selaras dengan kedudukan Islam sebagai Agama Persekutuan di dalam Perlembagaan Malaysia dan juga Peruntukan Undang-undang yang sedia ada termasuk menguatkuasakan undang-undang murtad.

2. Mendokong dan menyokong usaha mana-mana pihak untuk memperkukuh akidah umat Islam melalui program pendidikan dan kebajikan serta menuntut diperkasakan program tersebut termasuklah dengan mengembalikan semula bantuan yang secukupnya kepada sekolah agama rakyat.

4. Menuntut supaya badan-badan yang berkaitan dengan harta amanah umat Islam bertindak secara cekap bagi membantu umat Islam yang terpinggir dan tercicir supaya kehidupan mereka lebih terbela dan terjamin.

5. Menegaskan bahawa isu-isu berkaitan dengan akidah umat Islam ini adalah isu yang sangat sensitif yang boleh menjejaskan keharmonian kaum, justeru menyeru kepada semua pihak supaya tidak bertindak menyalahi undang-undang yang termaktub.

6. Menggesa supaya institusi-institusi yang mentadbir urusan umat Islam diserahkan kepada mereka yang benar-benar layak dan dihormati supaya institusi-institusi ini akan dilihat sebagai benar-benar berwibawa.

9. Mencadangkan supaya forum-forum seperti sidang meja bulat ini dijadikan platform muzakarah yang dapat menemukan semua pihak, pelbagai jalur pemikiran yang mewakili masyarakat madani dan parti-parti politik demi meninggikan syiar Islam di negara ini.

Manakala NGO yang hadir di sidang meja bulat semalam turut bersepakat untuk bergabung dalam membela Islam.

NGO yang hadir ialah Sekteriat Pemuda Perihatin, Yayasan Kepimpinan Malaysia, Ummah Prihatin Malaysia, ILMUAN, Pro– Guam, Perubatan Islam Darus Syifa', PAPISMA, GAMIS, INTELEK, PIMPINAN, ILMAM, Belia Islam Ampang (BISA), Ikatan Padu Rakyat Malaysia (IKATAN), Pertubuhan Muslim Professional (IMPROF), Ikatan Khidmat Muslim (I-Khidmat), Majlis Perundingan Melayu (MPM), GAGASAN, PMRAM, Usrah Kebajikan Profesional (UKP), Front Bertindak Anti Murtad (FORKAD), Umah Care, Terap Care dan Tabung Kebajikan Al-Masakin.

Gangguan manusia atau bencana alam?

Persatuan Pengguna Pulau Pinang (CAP) amat sedih dengan kejadian tanah runtuh yang berlaku di Kampung Sungai Ruil, Cameron Highlands yang telah meragut tujuh nyawa.

Sementara punca kejadian tanah runtuh yang melanda penempatan Orang Asli tersebut disiasat oleh pihak berkuasa, terdapat spekulasi bahawa kerja membersih tanah dan kerja tanah berdekatan penempatan itu untuk pembangunan perumahan oleh sebuah sebuah syarikat berkemungkinan telah menyumbang kepada bencana itu.

CAP telah memaklumkan kepada pihak berkuasa dalam surat bertarikh 26 Mei 2011 berhubung kerja tanah secara besar-besaran untuk pembangunan projek selepas menerima aduan daripada penduduk tempatan dan pelancong yang berang dengan keadaan itu.

Jabatan Alam Sekitar (JAS) telah mengarahkan pihak kontraktor supaya menjalankan kerja kawalan dan penstabilan cerun memandangkan kawasan itu terdedah dan berpotensi untuk terhakis.

Persoalannya ialah adakah pembangunan projek ini menjadi pemangkin bencana di Kampung Sungai Ruil?

Walaupun aduan dan amaran awal telah dibuat, kami merasakan bahawa tindakan wajar yang berkesan tidak diambil. Jika pihak berkuasa telah memantau dengan teliti sekitar Kampung Sungai Ruil, mengesan tanda awal kegagalan cerun dan bahaya yang akan berlaku, mungkinkah bencana ini boleh dielakkan?

Terdapat lebih daripada 600 kematian akibat tanah runtuh sejak 1973. Siapakah yang bersalah terhadap kematian ini? Dalam banyak kejadian, alam telah dipersalahkan, menyebabkan pesalah sebenar terlepas dan bebas.

Mengambilkira bahaya geologi yang serius yang telah menyebabkan kematian, kecederaan, kerosakan dan pemindahan penduduk, kerajaan Malaysia telah mewujudkan Pelan Induk Cerun Negara (National Slope Master Plan - NSMP) 2009-2023 yang antara objektifnya ialah untuk mengurangkan risiko sebelum tanah runtuh berlaku.

NSMP menyatakan bahawa di Malaysia, daripada 1973 hingga 2007, kira-kira 440 tanah runtuh dilaporkan. Terdapat juga lebih beribu-ribu kejadian tanah runtuh dan kegagalan cerun kecil yang 'tidak dilaporkan'.

Jumlah kerugian ekonomi akibat daripada kejadian tanah runtuh adalah dianggarkan lebih daripada RM3 bilion dalam tempoh 35 tahun lalu.

Kerajaan Malaysia mempunyai pelan induk cerun, butiran lengkap, komprehensif dan rangka kerja dasar yang berkesan, strategi dan pelan tindakan untuk mengurangkan risiko daripada kejadian tanah runtuh di kawasan cerun di seluruh negara.

Adakah pelan tindakan ini dilaksanakan dengan cekap dan berkesan?

Ramai daripada kita melihat bukit yang tandus, cerun yang terdedah akibat kerja tanah, pembangunan dan tanah runtuh ketika memandu sepanjang jalan utama dan lebuh raya di negara ini.

Kami bimbang cerun yang terdedah ini akan menjadi bencana yang akan datang. Kami berharap pihak berkuasa yang bertanggungjawab juga telah melihat kawasan yang terdedah kepada tanah runtuh dan tertanya-tanya sama ada tindakan telah diambil.

Apabila bencana berlaku, kami tahu bahawa tindakan yang wajar tidak diambil.

Kesan pembangunan di atas bukit, tanah tinggi dan hutan yang berleluasa akan berterusan jika pihak kerajaan membenarkannya.

Alam mempunyai batasannya dan kemerosotannya biasanya memberi kesan buruk dan bebanan berat kepada komuniti miskin dan penduduk asli. Tanpa mengambilkira kesan terhadap alam sekitar, pembangunan ekonomi akan melenyapkan sumber alam.

Kerajaan, ahli perniagaan dan pengguna perlu mula bertindak secara bertanggungjawab untuk kebaikan diri dan generasi akan datang sebelum bencana yang lebih dahsyat menimpa kita semua.

Tajudin: Settling out of court, and out of mind

This might be a test case and a taste of the future of other cases by the government and its agencies against any outstanding legal cases against other possibly well-connected VVIPs.

The one possible reason for trying to settle out of court, could be that these 'connected' persons may have incriminating evidence against others in positions of power, be they senior civil servants or politicians.

The danger of an open court case may implicate some of them which can be very embarrassing for those in power. The ongoing PKFZ case has exposed how the contracts, agreements, clauses, terms and so on were misinterpreted that are suspected of having resulted in billions of losses in the rakyat's funds.

There could be a fear that legal cases against Tajuddin may expose others in power and thus the option of out of court settlements which may not be revealed to the rakyat and thus cover up any misdeeds of those in power in the recent past and in the present.

What happened to all the cases reported to the police/ACA many years ago of suspected mismanagement/fraud in MAS such as the cost of supplying food to passengers? Or the UMBC case where Sime Darby was involved, with the case now over two decades outstanding.

It is common in the corporate sector not to take major disputes to open court as most of them may be due to non-compliance of internal controls and/or poor documentation and ineptitude of members of board of directors and senior management.

The position may not be any different in the case of the government and its agencies/authorities. Lack of action in the many cases of suspected mismanagement/fraud as noted in the regularly issued Auditor General's Reports is evidence of this, and some of the cases were reported several decades ago.

Big difference between Bersih and London riots

The recent London riots and looting is totally a different situation from the Bersih 2.0 gathering on July 9, because one is violent in nature while the other was a peaceful expression against an electoral system that has shown so much of ambiguity and suspicious handling over a long period of time.

Bersih neither had any violent inclinations nor ulterior motive to put the country in disarray and turmoil. Bersih was blown out of proportion by certain groups to make it look like an extremist movement out to create chaos and trouble.

Therefore, comparing what happened in London to that of Bersih's peaceful march for electoral reforms is like comparing an apple to an orange. It does not take an expert to analyse both the situations and conclude that one was purely peaceful in nature while the other had evil and destructive intentions to capitalise on a police shooting incident.

Our leaders are always seen to be quick to seek some kind of absolution and justification for their actions by making statements to intensify any given local situation.

The Bersih supporters did not throw missiles at the police on guard or riot or loot for that matter but in return the supporters were literally attacked by law enforcers with water cannons and tear gas, All these unnecessary use of force for a peaceful march to hand-over a petition to the king?

Most right thinking Malaysians can see the difference between the two situations and are not easily swayed to accept the authorities' mostly jagged analysis and explanations.

As general election draws closer, many attempts to coax, confuse and mislead the public by both sides, can occur at an accelerated pace. Thus one has to be cautious about falling into their game of chance and opportune.

We want people to lead the country with wisdom, justice and fairness to all. We do not want people who use the given power to undermine and persecute the public at the slightest opportunity. We want leaders who lead from the front and not from the rear.

We want a prime minister who takes control and accepts that faults can and do occur and not a Prime Minister who lets his subordinates to do the talking and take individual actions according to their own whims and fancies.

Free and clean election is our prerogative and it is one of the fundamental principles of a genuine democratic process.
