GMI tuntut 'pampasan setara' untuk tahanan ISA Posted: 15 Sep 2011 10:38 PM PDT Gerakan Mansuhkan ISA (GMI) hari ini menuntut kerajaan memohon maaf dan membayar "pampasan setara" kepada tahanan ISA dan keluarga mereka susulan tindakan kerajaan mahu menghapuskan akta tersebut. "Semua mangsa ISA perlu dibayar pampasan setara dengan penyeksaan dan pengalaman pahit yang telah dilalui oleh tahanan dan keluarga," kata Pengerusi GMI Syed Ibrahim Syed Noh dalam sidang media di ibu negara. Pampasan itu, kata Syed Ibrahim (gambar atas, tiga dari kanan) perlu dinilai kerajaan berdasarkan beberapa perkara, antaranya tempoh ditahan, kos ulang alik ke kem tahanan dan keruntuhan rumah tangga. "Kami berharap kerajaan benar-benar serius untuk membuat penilaian... Ini yang perlu dikaji oleh kerajaan," katanya. Semalam, Najib dalam pengumuman khas yang disiarkan secara langsung di RTM berkata kerajaan akan memansuhkan ISA dan Akta Buang Negeri 1959. Selain itu, kerajaan juga akan mengkaji semula beberapa undang-undang lain bagi memastikan ia memenuhi kehendak semasa dan " tidak akan teragak-agak untuk meminda atau memansuhkan undang-undang yang tidak lagi relevan". Kajian semula komprehensif itu akan melibatkan Akta Kediaman Terhad 1933 dan Akta Mesin Cetak dan Penerbitan 1984 di mana prinsip pembaharuan tahunan akan dihapuskan dan digantikan dengan pengeluaran lesen sehingga dibatalkan. Bercakap dalam sidang media di ibu negara pagi ini, Syed Ibrahim berkata berdasarkan perkembangan terbaru itu, mereka juga menuntut: Semua "pemuka" yang terlibat dalam menyeksa tahanan ISA mesti di bawa pengadilan. Kerajaan, menteri berkenaan dan polis mestilah amanah dalam melaksanakan pelbagai prinsip yang ditegaskan oleh perdana menteri dalam ucapannya bukan sekadar "servis bibir". Kerajaan mestilah memansuhkan lain-lain undang-undang tanpa bicara seperti Akta Dadah Merbahaya. Kerajaan melaksanakan kajian semula dengan segera dalam tempoh yang spesifik terhadap undang-undang yang menghadkan kebebasan rakyat dan media seperti Akta Polis dan Akta Mesin Cetak dan Penerbitan. Kerajaan mesti patuh kepada piagam hak asasi manusia antarabangsa dalam soal berkaitan aktiviti antipengganas dan melakar pelan jangka panjang dalam membangunkan mekanisme menanganinya keganasan tanpa menjejaskan hak-hak asas dan prinsip keadilan Kerajaan mesti menangani dan mengesahkan International Covenant on Civil and Political Right (ICCCPR) dan Covention Against Torture dan Other Cruel, Inhuman or Degrading Treatment or Punishment (CAT). KPN jumpa AG kemuka pandangan kaji Akta Polis Posted: 15 Sep 2011 10:29 PM PDT Ketua Polis Negara Tan Sri Ismail Omar akan bertemu dengan Peguam Negara Tan Sri Abdul Ghani Patail bagi memberi pandangan terhadap kajian semula ke atas Seksyen 27, Akta Polis 1967 berhubung kebebasan berhimpun. Beliau berkata pandangan yang akan disampaikan oleh Polis Diraja Malaysia (PDRM) meliputi aspek bagaimana hendak mengimbangkan kesejahteraan, hak bersuara dan hak berkumpul di kalangan rakyat. "Perkara ini adalah untuk kepentingan rakyat supaya keamanan dapat terus dikekalkan," katanya kepada pemberita selepas menghadiri sambutan serentak Hari Malaysia dan Hari Kebangsaan di Dataran Merdeka di Kuala Lumpur hari ini. Semalam Datuk Seri Najib Tun Razak mengumumkan kerajaan akan mengkaji semula Seksyen 27, Akta Polis 1967 dengan mengambil kira peruntukan Perkara 10, Perlembagaan Persekutuan tentang kebebasan berhimpun dengan prinsip menentang sekeras-kerasnya demonstrasi jalanan. Perdana Menteri berkata kebenaran berhimpun akan diberi selaras dengan kaedah-kaedah yang akan ditetapkan kelak dengan mengambil kira norma-norma di peringkat antarabangsa. Ismail berkata pengumuman yang dibuat Perdana Menteri malam tadi menunjukkan kesungguhan kerajaan untuk terus melangkah ke hadapan dan dibuat demi kepentingan rakyat. "Saya lihat (kajian semula) undang-undang lama ini kita perakukan juga...setuju kerana sudah lapuk," katanya. No-fault liability is the better scheme Posted: 15 Sep 2011 02:28 AM PDT The government has not accepted CAP's proposal for a No-Fault Liability (NFL) scheme for road accident victims and has instead decided to maintain the present system with some changes. The new third party motor cover which will be implemented early next year is also a fault-based liability (FBL) system. Accident victims will lose out with the rejection of the NFL scheme. Since the new motor scheme is still based on the principal of FBL, it will not be different from the current scheme as at the end of the day the affected motorist will still: bear the risk of his claim being rejected by insurers; have to retain lawyers to take the matter to court; have to await the court's decision as to who is at fault, and what amount ought to be paid. The FBL scheme also fails to achieve the object of giving maximum benefit to accident victims. Out of every ringgit of premium collected 30 cents go to commissions and management expenses. If lawyers' fees are deducted less than 50 cents will go to the victim. In an NFL scheme, no commissions and lawyers' fees need to be paid and the administrative expenses would be less than 10 percent of the amount collected. Thus 90 percent of the amount is available to compensate and rehabilitate victims and provide them other benefits. Another disadvantage of continuing with a FBL system is that motor accidents will continue to rise. The number of motor accidents was 265,416 in 2001, rose to 363,319 in 2007 and reached 414,421 in 2010. However, in an NFL scheme one of its foremost aims is the prevention of accidents and the promotion of road safety. The NFL scheme puts great emphasis on accident prevention in order to reduce the number of claims. The implementations of the NFL in Victoria, Australia saw a 29 percent drop in road fatalities between 2000 and 2009. If we can reduce road fatalities, this will itself lead to reduction in costs to the courts, in terms of manpower and time when the many road accident cases are being heard. According to the latest statistics available, there were approximately 11,890 insurance claims pending in the Magistrates Courts throughout Malaysia in July 2006. As of June 2006, there were about 32,267 insurance claims pending in Session Courts. Claims for compensation arising out of road accident ranked the second highest amongst the total number of civil cases filed during the same period. By switching to NFL, the courts will be freed to hear non-accident cases. Thus the NFL is a better scheme for road accident victims. The reasons given by Bank Negara Malaysia (BNM) as to why the NFL could not be implemented are not convincing. Firstly, BNM claims that it is the general public which wants to maintain the existing FBL system. However certain vested groups lobbying for the maintenance of the FBL system can in no way be construed as "public" consensus. Had the public been given sufficient information on the merits of the NFL schemes compared to the existing FBL system, they would have chosen NFL system. When the Attorney General Chambers proposed a NFL scheme in August 2007 and had consultation with all interested parties including NGOs, it must have been convinced that the current FBL scheme is not benefiting the victims of road accidents. When BNM also organised a consultation in 2007 and brought experts from countries practicing the NFL scheme to explain how the scheme is carried out and the problems faced, it also must have believed in the merits of NFL. Thus we do not understand the turn around by BNM and the rejection of the NFL. The second reason is this: The NFL could not be implemented because a majority held the view that putting a limit on the amount of compensation for injuries suffered is a violation of a person's constitutional rights. This view is mistaken as there is no constitutional right to unlimited damages. BNM had at one time suggested a RM2 million limit on the amount of compensation for injuries, which is an acceptable figure. The sum that an accident victim can successfully claim for general damages for pain and suffering in the Malaysian court will depend on case law and the Civil Law Act 1956, which itself was amended to limit the damages recoverable in fatal accident cases. The third reason given is this: The NFL scheme would need a strong complementary infrastructural support (e.g. fraud prevention and establishment of rehabilitation centres.) for it to work. Since money and time would be needed to move to the NFL scheme, it was rejected. The NFL is not expected to be implemented immediately. A committee of experts would have to be appointed to plan in detail the establishment of the scheme. Complementary infrastructural support will grow and develop along with the expansion of the NFL. As we have emphasised to BNM before, SOCSO is a good example of a NFL scheme which is viable and working well. SOCSO today is a far cry from SOCSO of the early 1980s when CAP highlighted its shortcomings. So why cannot we have a similar scheme for road accident victims? The implementation of the NFL scheme would take time, maybe a year or two but it is worth the wait because accident victims will benefit from it. It is unfortunate for them that this will not be happening. The main issues and problems with the current FBL system cannot be solved by the new third party motor cover but only by the introduction of NFL cover. CAP reaffirms its stand that the new FBL based scheme will not benefit accident victims and should be scrapped. Government must put the interest of road accident victims above that of parties which push for a FBL scheme in order that they may continue to profit from it. Doubts over MAS and AirAsia's tie-ups with QPR Posted: 15 Sep 2011 12:55 AM PDT Many years ago there was this advert running on British Television promoting fresh cow's milk featuring the legendary Liverpool/Wales striker Ian Rush saying 'if you don't drink enough milk you will end up playing for Accrington & Stanley' and then the other person asks 'Accrington who?' to which Ian Rush replies 'exactly'. The current spate of Malaysian personalities buying not so known British Football Clubs raises the same sort of feeling and queries. But hey, they are spending their private money so it is nobody's business to question anything. Well, until recently that is. When Tony Fernandes bought QPR many of us thought it was not a wise move but each to its own. However, I did tell my friends back then to just wait few months and we will find AirAsia sponsoring them. Well, we didn't have to wait months, just within one month, not only AirAsia but MAS as well had jumped on the bandwagon. Both Air Asia and MAS are publicly listed companies and I believe the sponsoring of the owners'/directors' private enterprises should be considered a related party transaction and therefore should get shareholder approval at a general meeting. Now are the regulators going to question this? Even if no Malaysian rule was broken, surely this is bad corporate governance? Lets not even go to calculating return on investments for these sponsorship sums which is a separate matter altogether. MAS is clocking up operating losses - surely sponsoring a lower echelon football club should not be on its priority spending list, given the dire straits it's in and the pressure it is facing from unions. Based on the published second quarter operating results, MAS suffered a staggering second quarter loss of RM526 million and a cumulative six month period loss up to 30th June 2011 amounting to RM767 million. Let us not forget the past restructuring of MAS including the widespread asset unbundling exercise which involved lot of taxpayers' money. Imagine the furore that would erupted if Warren Buffet were to buy say Norwich City Football Club privately and then get Berkshire Investment to sponsor shirts or stadiums. This is why a public company which is only 25 percent owned by public and 75 percent owned by just one or two persons should not really be categorised as a public company. Previously I had raised questions why Telekom was sponsoring Manchester United or Petronas sponsoring FI teams when both do not have global products or services for sale. So is this all about suiting the personal preference of someone but which brings no benefits to the company? Off course the public relations and marketing gurus will rubbish me and say these are corporate advertising strategies to enhance the company's image. But public companies do not have to be extravagant. There are so many more alternatives to do this without going over the top. Indeed some Malaysian government agencies and companies have even taken to spending a lot of money buying advertisements in foreign papers which are again superfluous and wasteful. All I can say is really "Mana Ada Sistem".

P Pinang sokong tubuh peronda sukarela Posted: 14 Sep 2011 10:11 PM PDT Pulau Pinang telah mencatat penurunan kadar jenayah yang paling besar di Malaysia - sebanyak 27 peratus tahun lalu dan penurunan 25 peratus untuk tempoh enam bulan pertama tahun ini, kata Ketua Menteri, Lim Guan Eng. "Antara faktor penurunan kadar indeks jenayah adalah kerjasama dan sumbangan gigih Pasukan Polis Diraja Malaysia (PDRM), khususnya Ketua Polis Negeri, Datuk Wira Ayub Yaakob, pemasangan kamera litar tertutup (CCTV) di lokasi yang kerap mengalami jenayah dan juga kepolisan masyarakat. "Kepolisan masyarakat adalah satu syarat penting untuk menjaga keselamatan awam. Demi memastikan kadar jenayah boleh terus menurun, maka kerajaan negeri Pakatan Rakyat (PR) Pulau Pinang akan menyokong penubuhan Pasukan Peronda Sukarela (PPS) untuk membantu pihak polis menjalankan rondaan," kata Lim dalam satu kenyataan hari ini. Katanya, sokongan PPS dengan pihak polis diharap dapat mengekalkan kententeraman awam dan menjadikan Pulau Pinang negeri paling selamat di Malaysia yang sedikit sebanyak akan membolehkan Pulau Pinang terus menjadi pilihan utama pelabur dan pelancong. "Antara objektif penubuhan PPS ini adalah untuk membantu pihak berkuasa Keselamatan dalam menangani kegiatan atau aktiviti sosial yang negatif di sesuatu kawasan termasuk membersihkan kawasan daripada anasir dadah," katanya. Selain itu, tegas Lim, penubuhan PPS juga sedikit sebanyak dapat membantu PDRM mencegah dan membanteras jenayah, dengan bertindak sebagai pembekal maklumat, di samping menjalin hubungan kerjasama kejiranan yang erat di kalangan anggota masyarakat tempatan. "Sehingga 14 September 2011, terdapat 40 pasukan dengan 840 ahli. PPS ditubuhkan sebagai langkah untuk memastikan kebajikan dan keselamatan masyarakat dan rakyat negeri Pulau Pinang tidak dipinggirkan," katanya.

Ramlah Adam: British benar-benar jadi penasihat Posted: 14 Sep 2011 09:58 PM PDT Ahli akademik pro-Umno Datuk Ramlah Adam menegaskan, polis yang berkhidmat ketika tragedi Bukit Kepong bukan polis British, sebaliknya berkhidmat dengan negeri Melayu yang berdaulat. Katanya, pada zaman itu, British benar-benar menjadi penasihat kepada raja-raja Melayu dan arahannya tidak lagi mesti diikuti, berbeza dengan keadaan ketika Perjanjian Pangkor dimeterai pada tahun 1874. "British buat perjanjian bertulis dengan raja-raja Melayu bahawa mereka ketua negeri masing-masing. Dan bila dilantik menteri besar, yang lantik menteri besar sultan, yang lantik pegawai kerajaan sultan. "British hanya British adviser (penasihat British). Buat kali pertamanya British adviser memang betul-betul adviser, berbeza dengan Perjanjian Pangkor 1874 yang ditulis bahawa nasihat itu mesti diikuti," katanya. Bercakap dalam forum Mat Indera di Kuala Lumpur malam tadi, Ramlah berkata, selepas orang Melayu menolak Malayan Union dan Persekutuan Tanah Melayu dibentuk pada tahun 1948, raja-raja Melayu telah dipulangkan kuasa mentadbir negeri dan jajahan takluknya. "Hanya Kuala Lumpur bawah British (ketika itu)," tambahnya. Sehubungan itu, katanya, dakwaan Timbalan Presiden PAS Mohamad Sabu bahawa polis pada masa itu bekerja untuk British dan Tunku Abdul Rahman sebagai pegawai British adalah "sangat salah". "British hanya berkuasa dalam pentadbiran, bukan kedaulatan. Ini kejayaan Melayu terbesar, tolak penguasaan British melalui Malayan Union," katanya. [Berita penuh menyusul]

Colonialism by any other name is still colonialism Posted: 14 Sep 2011 01:30 AM PDT Debates in post-colonial countries over who really led the independence struggle are nothing uncommon. The Filipinos recently commemorated the centenary of the birth of their official national hero, Jose Rizal. The occasion reignited an old debate as to whether the country's hero of independence should really be the radical plebian, Andres Bonifacio (who led the 1896 revolt against Spanish colonialism), rather than Rizal (who actually opposed the resurrection). The latest phase of this old controversy in our country was unfortunately marred by a high degree of political partisanship. But even for those of us who for this reason refrained from entering the fray, there was one statement by a protagonist in the debate which cannot go unchallenged. This is the startling claim by a history professor that our country was never really colonised by the British. "Startling" because it implies that all those who resisted British intervention were fighting a chimera. "Startling" because it suggests that people like Maharaja Lela who led a revolt against the British were suffering from some hallucination. The basis for this claim is that according to colonial juridical theory the Malay states were "protected" states as distinct from colonies. Zainal Kling, the professor in question, claimed that Malaya had in fact "never been colonised" and was only a "protectorate" of the British. "Being a protectorate is not the same as being colonised ... Only three states were colonised - Singapore, Malacca and Penang ... Stop saying (Malaya) was colonised for 400 years. That is a big mistake," he said. Mistake indeed! The learned professor is obviously ignorant of the fact that as far back as 1935 Rupert Emerson, a Professor of Government at Harvard University, had in his study on "Malaysia" (which is aptly subtitled "A Study in Direct and Indirect Rule") shown up this so-called distinction to be nothing more than a piece of legal fiction. As the American don noted: "Unfortunately, there is neither simplicity nor straightforwardness about the concept of the protectorate or the protected State... The obvious difficulty is that the device of the protectorate has been a very useful one for the Powers in their imperialist exploits and they have not hesitated to twist it in any direction which would suit their immediate purposes. "In its origins the establishment of a protectorate has very frequently been no more than a preliminary to the establishment of full colonial rule, a device utilised because of its greater economy and its more tentative, but still sufficiently conclusive, character in relation to third States. "In other instances, as in the Federated Malay States, a virtually complete colonial administration has been set up but the form of the protectorate has for one reason or another been retained. Given such situations, in which words are often used to conceal rather than to explain the reality, it is difficult to arrive at any final and satisfactory terminology or definitions which do more than skim the legal surface. "But of one thing one may be sure: what is being protected is the interest of the protecting State and of the economic groups within it which profit from imperialism." (Emphases added.) Further, Emerson goes on to point out that even Lord Lugard, the creator of the system of indirect rule in Nigeria, had admitted that "the distinction between the two is now without practical difference", while a Dutch authority had bluntly declared in 1916 that "the colonial protectorate must be regarded as a disguised colony." It is indeed astonishing that an American academic could see through this piece of colonial sophistry in the 1930s while a professor in a Third World country which has been independent for more than 50 years is still perpetuating such myths. It can only be explained by the persistence of colonial thinking in our universities and the enduring hold that colonial scholarship continues to have on the curricula. It was in an attempt to highlight this problem that we in Citizens International organised an international conference in June this year on "Decolonising Our Universities". While the effort was indeed fruitful, it is clear that that there is still a lot of work to be done. SM Mohamed Idris is the chairman of Citizens International.

Now not everyone can fly AirAsia Posted: 14 Sep 2011 12:52 AM PDT Once upon a time , AirAsia's slogan was 'Now everyone can fly.' But nowadays this no longer holds true. In the beginning, AirAsia was really making a serious effort to enable everyone to fly on the no frills airline. Fares were not only cheap for those who purchased their tickets in advance. Also there were no hidden costs and the total fares after taxes were cheap and really affordable to the man in the street. In fact if you were lucky enough the tickets you bought could even be cheaper than the cost of the ticket for a long haul bus. Not only were there cheap tickets but there were a lot of extras that normal airlines did not provide. Senior citizens above 60 were given priority of boarding, you could select any seats of your choice, there was no such thing as fuel surcharge added to the cost of the ticket. In short, there were no hidden costs. But AirAsia , nowadays cannot boast of its 'now everyone can fly' slogan because its concept has been totally altered. Now, its policy is to charge for everything. Senior citizens no longer have the privilege of boarding first. If you want to board first you have to pay for priority boarding. If you want to select your favourite seats you have to pay for it. Just you think that is the end of it, you are hit with another cost. It's call processing fees for using a credit card for your online booking. It seems that the credit card company commission is even passed to the passenger in the guise of processing fees. The moral of the story is that we should no longer be deceived by the AirAsia slogan of 'Everyone can fly'. Maybe its time travellers should revert back to our national carrier MAS. At least there are no hidden costs and what you pay is transparent. And if you are a golfer the more reason why you should travel MAS because they don't charge you for your golf bags whereas AirAsia charges RM50 for that extra luggage. And if you are a handicapped person, please be aware that AirAsia charges RM15 for using their wheel chair. Lastly, MAS provides you the luxury of boarding and landing using an air bridge whereas with AirAsia, you have to be content with climbing up and down a gangway to board and disembark your flights. The reason? Because AirAsia can save paying the airport authorities for using the facility at the expense of discomfort to the paying customers.

10,000 pengundi kes 'MyKad palsu' dikeluarkan - PAS Posted: 13 Sep 2011 10:53 PM PDT Pemuda PAS mendakwa Suruhanjaya Pilihan Raya (SPR) dalam tempoh dua bulan telah mengeluarkan nama lebih 10,000 pengundi yang dikaitkan dengan kes kad pengenalan palsu. Pengerusi pemulihan demokrasi dan mobilisasi dewan itu Suhaizan Kaiat berkata, perkara itu dikesan setelah pihaknya rancak mengenalpasti keraguan dalam daftar pemilih. "Bukan mudah untuk sesuatu jabatan kerajaan menjejaki lebih 10,000 kes kad pengenalan palsu dalam waktu dua bulan. "Persoalannya apakah JPN (Jabatan Pendaftaran Negara) sememangnya sudah memiliki senarai kad pengenalan palsu yang akan dimasukkan dalam daftar pemilih SPR untuk tujuan manipulasi pilihan raya?" soalnya. Pada sidang media di pejabat PAS di Kuala Lumpur hari ini, Suhaizan turut mengedarkan senarai sepuluh nama bagi membuktikan dakwannya. Umno S'gor saman PAS berhubung serbuan JAIS Posted: 13 Sep 2011 10:52 PM PDT Umno Selangor hari ini memfailkan saman terhadap setiausaha agung PAS, Datuk Mustafa Ali dan lima lagi responden berhubung dakwaannya Umno menjadi dalang serbuan Jabatan Agama Islam Selangor (JAIS) terhadap premis Gereja Methodist Damansara Utama (DUMC) bulan lalu. Saman itu menuntut pampasan RM10 juta dari setiap responden berhubung kenyataan Mustafa itu yang disiarkan oleh akhar rasmi PAS - Harakah - serta menuntut pemohonan maaf untuk disiarkan dalam akhbar berkenaan. Lima lagi responden ialah Presiden PAS, Datuk Seri Abdul Hadi Awang; Mohamad Sabu (timbalan presiden), Angkatan Edaran Enterprise (pencetak), Ahmad Lutfi Othman (ketua pengarang Harakah) dan wartawan Khairul Azlam Mohamad. Bagaimanapun, Hadi dan Mohamad dianggap sebagai satu responden kerana kedua-duanya mewakili pemimpin tinggi PAS dalam saman tersebut. Setiausaha Perhubungan Umno Selangor, Datuk Seri Mohd Zin Mohamed memfailkan saman tersebut di pejabat pendaftar Mahkamah Tinggi Shah Alam kira-kira jam 11.50 pagi ini. Menurut saman tersebut, Mustafa - yang juga pemegang permit Harakah - didakwa mengeluarkan "kata-kata fitnah" yang diterbitkan dalam Harakah edisi bertarikh 19 Ogos hingga 21 Ogos 2011. Artikel itu bertajuk 'Pas akan dedah bukti, Umno main peranan operasi JAIS'. "Tuduhan-tuduhan tersebut tersebut sangat serius di mana menyebabkan kehinaan dan keaiban kepada plaintif oleh khalayak ramai dan masyarakat awam, baik di Malaysia dan antarabangsa," saman itu dipetik. Umno Selangor juga turut memohon injunksi mahkamah untuk menghalang Mustafa - defenden pertama - atau pembantunya atau ejennya daripada menerbit atau menyebabkan penerbitan "kata-kata fitnah" itu di media cetak atau elektronik. Dalam sidang media selepas itu, Mohd Zin berkata saman terpaksa diambil oleh Umno negeri itu untuk mempertahankan diri walaupun pihaknya beberapa kali menyatakan kesediaan untuk menyelesaikan di luar mahkamah dengan permohonan maaf. Tetapi, katanya, tawaran itu ditolak oleh PAS. Sehubungan itu, katanya, mahkamah menetapkan 28 September ini sebagai tarikh pengurusan kes saman tersebut.

Jerebu pada tahap membimbangkan Posted: 13 Sep 2011 04:16 AM PDT Jerebu yang kini dialami oleh kawasan pantai barat Semenanjung Malaysia amat membimbangkan. Pada hari ini, negeri Selangor merakamkan bacaan indeks pencemar udara (IPU) yang amat tinggi, khususnya di kawasan berhampiran Kuala Selangor (97) dan Nilai, Negeri Sembilan (98). Merujuk kepada peta satelit, jelas dilihat bahawa punca jerebu kali ini adalah pembakaran yang berlaku di Sumatera, Indonesia. Mengikut laporan yang disediakan oleh Jabatan Meteorologi Malaysia, bilangan "hotspot" yang terdapat di Sumatera mencapai 202 pada 11 September, manakala tiada yang dikesan di Semenanjung Malaysia. Pada hari ini, bilangan hotspot telah menurun sedikit, dengan 34 dikesan. Jelas bahawa punca jerebu kali ini berada di luar kawalan Kerajaan Negeri Selangor. Walau bagaimanapun, Kerajaan Negeri Selangor bersama-sama agensi kerajaan telah meningkatkan usaha pemantauan untuk memastikan pembakaran tempatan tidak memburukkan lagi keadaan. Saya ingin menggesa Menteri Luar Negara untuk memberi keutamaan kepada kesihatan rakyat Malaysia dengan menyuarakan bantahan terhadap pembakaran yang berlaku di Sumatera kepada kerajaan Indonesia. Keadaan berjerebu ini telah pulang berulang kali tahun ini. Saya juga ingin menyeru kerajaan pusat untuk menyiasat semua syarikat-syarikat Malaysia yang memiliki ladang di Sumatera untuk memastikan mereka lebih bertanggungjawab dalam kaedah pertanian mereka. Segala aktiviti pembakaran yang dijalankan bukan sahaja menjejaskan nama negara tetapi malang lagi, jelas memberi kesan teruk terhadap rakyat Malaysia. Penulis adalah ahli exco kerajaan negeri Selangor dan ADUN Bukit Lanjan.

3 hari berlalu, mana senarai masuk Umno? Posted: 13 Sep 2011 01:14 AM PDT Sudah berlalu tiga hari cabaran Dewan Pemuda PAS kawasan Padang Terap. Nampaknya, tiada respons daripada kepemimpinan Umnobahagian Padang Terap. Gagallah mereka mengemukakan senarai ahli PAS tersebut. Bukan main gegak gempitanya pengumuman 'pembohongan' tersebut. Saya percaya akan timbul lagi pengumuman-pengumuman serupa. Malah akan ada beratus-ratus malah beribu ahli PAS akan menyertai parti korup Umnomenjelang pilihan raya umum (PRU) ke-13. | Sehingga, lojiknya PAS Padang Terap hanya akan berbaki yang dipertua, setiausaha, ketua Pemuda, ketua Muslimat dan ketua ulama sahaja. Teknik yang sudah tidak releven di zaman generasi X dan Y. Zaman Jepun bolehlah. Ada beberapa teori kegagalan: (1) Memang berita yang keluar itu satu berita bohong, penceritanya adalah pembohong dan orang yang percaya adalah orang yang kena bohong. Medianya pun pembohong juga. Parti yang mendakwa mendapat ahli PAS itu pun bohong. (2) Gagal untuk membuktikan isu sebenar, maka spin jadi isu komunis. Sebenarnya hanya untuk menyelamatkan karier politik seseorang. Untuk membuktikan 'kejayaan' mempengaruhi rakyat. Bila bawa isu komunis dalam masyarakat yang bergelumang dengan perjuangan kemerdekaan, maka gagallah jawabnya. Berapa orang keluar sebab komunis. Bahkan pekung Umno semakin terbuka apabila profesr yang mesra Umno sendiri mengakui bahawa negara ini tak pernah terjajah. Itu, kita serah kepada ahli sejarah dan akademik. (3) Umno akan gunakan nama yang sama untuk mengumumkan ahli PAS yang keluar Umno. Selepas ini akan ada tempat lain yang akan umumkan. Modus operandi ini sudah lama PAS tidak gunakan di Padang Terap. Kalau Umno nak mulakan, ayuh! Selepas Pakatan Rakyat perintah Kedah, kita berkhidmat tanpa kira parti. Nampaknya Umno sudah mula timbulkan kegelisahan di celah keharmonian masyarakat di Tandop Besar. (4) Kerisauan kebangkitan ahli Umno lain yang dipinggirkan bantuan. Walaupun sudah lama berjuang. Saya mengucapkan tahniah kepada keluarga 'PAS' yang mendapat durian runtuh dalam bentuk bumbung baru. Saya percaya banyak ahli Umno sendiri tak dapat. Boleh sahaja kita senaraikan nama ahli Umno yang sedang menunggu bantuan di kampung Tandop Besar. Yang betul-betul susah. Bahkan seluruh Padang Terap yang merempat. Ingatlah betapa beruntungnya anda semua menjadi ahli PAS. (5) Umno terkejut. Rakyat Padang Terap terkejut. Rrakyat Malaysia, bahkan ahli Umno sendiri terkejut dengan pendedahan yang dikeluarkan berkenaan salah guna secara tidak beretika pemimpin Umno Padang Terap duit sebuah syarikat pembinaan. Yang diambil untuk tujuan aktiviti parti Umno. Duit tu hak milik rakyat negeri Kedah yang dikurniakan Allah. Buat apa ambil. Salah seorang rakyat yang membaca maklumat yang tersebar ini mengatakan: "Aku tida reda walau setitik air atau sebutir nasi yang dimakan oleh perwakilan Umno dengan menggunakan duit rakyat, iaitu aku". Sebelum ini mereka anggap Umno adalah parti yang kaya. Maka silap, yang kaya ialah pemimpin Umno. (6) Kerisauan bahawa ada lagi pendedahan yang akan dibuat. Silakan umum lagi dan ada lagi penyelewengan yang saya akan bongkarkan. Silakan. Saya tahu masyarakat celik IT sedang memerhatikan dengan dekat cabaran saya. Ada juga kalangan pemimpin Umno yang bertepuk dan bersorak dengan pendedahan saya. Adakah hanya dengan sekadar cabaran cek kosong? Nantikan adegan seterusnya. What is Pakatan's stand on PPSMI? Posted: 13 Sep 2011 03:28 AM PDT While the present government is still dragging its feet in studying the possibility of having both PPSMI (Teaching and Learning Of Science and Mathematics in English) and MBMMBI running concurrently, Pengerusi Lajnah Pendidikan, Abu Bakar Chik was recently reported as saying that PAS totally rejected PPSMI and even questioned PAGE's struggles. It seems to me that PKR and PAS have publicly objected to and totally rejected PPSMI while DAP appears to prefer having PPSMI option in national schools, with science and mathematics taught in Mandarin and Tamil in vernacular schools. Combined, PAS and PKR simply overwhelm DAP on this issue. With many parents from both urban and rural areas, including Malays clamouring for PPSMI, we should both implemented concurrently in Sekolah Kebangsaan. Parents will then having a choice of either English or Bahasa Malaysia (with Mandarin and Tamil in the vernacular schools) as the medium of instruction for both these subjects. This would be fairest and most accommodating to all. With GE13 expected soon, it is time pro-PPSMI parents (who are perceived minority but actually silent majority) consider carefully who and which party to vote for. We must make brave and educated decision by voting for a government that is prepared to implement education policies fairly, especially those specifically provided for in the education acts and does not run contrary to the constitution of our country. The people's constitutional right to PPSMI must not be left to the whims of politicians! Pakatan Rakyat, tell us NOW, not after the elections, of your plans for PPSMI if any.

Why I don't celebrate National Day Posted: 13 Sep 2011 01:54 AM PDT I don't care for National Day. I don't celebrate National Day. I don't put up flags, I don't watch the parade. I don't listen any of those manufactured nonsense theme songs like 'Satu Malaysia'. The only thing I celebrate is that I don't have to turn up for work that day. In fact, every morning of that day I wear casual clothes to enjoy my nasi lemak at a kopitiam. Honestly I don't have reason to celebrate. Why? For what or whom should I celebrate? For BN, MCA, or Perkasa? Celebrate that one political party that has hijacked my country for 54 years, its institutions and everything it stands for? Celebrate that BN has become a 'big brother' in Malaysia, a government which in turn has become the 'communist' government? The lines are so blurred that I don't even know what is right or wrong in the end. Malaysia, BN, Umno, MCA, MIC, Gerakan, PPP, PBB, Perkasa and everything in between seems to be nothing more than extensions of one monolithic entity that seeks to control every aspect of our lives, like religion, culture, education, business, and living lifestyle. We could read practically everyday news about the discrimination of the Chinese or Malay, ISA against civilians or parties who are opposed to the BN, corruption cases, and only everything that is good about BN. Using fear to control Malaysians, they turn into slaves to help BN build a mega corporation. Celebrate that? Seriously? Everywhere I turn there are banners with all sort of feel good, sound good exhortations to '1Malaysia'. The prime minister his ministers show '1' with their first finger and smile down benevolently at us while pictures of citizens are conveniently photoshopped beside them as if to say we are all one people, one nation. National day, BN day - what's the difference? Those posters and banners put up by the town councils and grassroots organisations seem identical to those election banners and posters put up by the BN during election. Who really knows the difference? The only thing I know is between the political leaders and us there is Satu Malaysia, two different rules. The first rules are apply to the BN. The second rules apply to the civilians. They make millions while we try to eke out a living, we stay together while they move ahead. 'Satu Malaysia' is for suckers who still buy that crap. It's very telling that among that challenges spelled out by PM Najib Razak, is that corruption can be found in every single government project. Can I count on the government to bail me out when I'm poor and jobless? Can I count on the government to treat me when I am sick and penniless? Can I count on the government to provide me with a social safety net? Can I count on the government when I get old and alone? It used to be said at least you can count on your EPF when you've reached retirement. Now who the heck knows, the newspapers say EPF had lost money, and BN went ahead and changed the regulation to prevent EPF funds from becoming insolvent. They can actually not pay you the money which they took away without asking your permission. As a Malaysian, who can I really count on except myself? I think at some point during the celebrations, everyone was supposed to stand up and sing Negaraku together. Do these people even know what they are singing or are they just going through the motions? Do they even know the true meaning of Negaraku? I for one did not sing Negaraku for it would be a tacit support of a gross hypocrisy. When one thinks of democracy, Malaysia is just about as far away from that as you can get. The truth is there is nothing in the world I want more than to celebrate National Day, to proudly stand and declare, "I'm Malaysian". But I can't. I can't celebrate National Day while Malaysia remains a nation in captivity and its people are stripped of their rights and civil liberties. I can't celebrate National Day until Malaysia is returned to its rightful owners - the people of Malaysia regardless what race you are. Put another way, if some goon came into your house and stole all your stuff, you sure as hell don't celebrate that.
